A. Refund Policy

1.
Youpark return / refund policy is subjective to the ‘developers’ return / refund policy in which case the developer may accept or reject the refund claim. Youpark is committed to serve the customers with best applications and software.

2.
If you are not satisfied with the application(s) or software(s) purchased from Youpark or its Partner’s site, please immediately contact at REFUND@nclubsoft.com or fill in the refund form within 15 days of the purchase with the purchase order number and a “valid reason” for the return request.

3.
We request all the customers to directly contact Youpark in any return / refund instance because it is Youpark’s responsibility to contact the developer for all return / refund claims. In such instances, customers are requested to allow reasonable time to Youpark for return / refund claims.

4.
In case of successful settlement where the customer money is refunded by Youpark, the customer is requested to delete the program / software / product from his custody which was downloaded or purchased from Youpark or any of its value added channels. It also implies that customer will also remove or delete the registration code of the product along with any source (email, SMS etc) that was sent to the customer to communicate registration code.

5.
Youpark cannot offer refunds in cases such as:

Software purchased mistakenly for the wrong device or platform
Promotion codes not provided during the purchase process

6.

Any modifications in the policy shall also be posted on these websites. B. Support Policy

1.
Youpark is committed to efficient user support to its users and considers maintaining strong relations with its users and partners as a vital element of its success strategy.

2.
In case the user has a problem or a query regarding issues pertaining to Youpark, he/she can contact Youpark support team round the clock at support@nclubsoft.com or fill in the Support form. The user can also fill in the Customer Service Form in order to reach our support team. They can also provide their suggestions at admin@nclubsoft.com.

3.
Under normal circumstances, Youpark support team shall respond to the user queries within 1 Business Day.

4.
Software developer’s primary responsibility is to address user support issues related to Product Keys, Defects, Bugs, Technical problems associated with a particular product. In this case, Youpark will act as an intermediary party between the user and software developer and the user should contact Youpark at support@nclubsoft.com in the first instance.

5.
On the other hand, if the user requires more information regarding the installation or usage of product/products, such type of queries should be sent by the user directly to the developer’s contact information provided with the product on www.nclubsoft.com.

6.
Youpark, its partner or the Software Developer shall not be responsible for free software, Trial software or software purchased mistakenly for the wrong device or platform by the user.

7.
Youpark’s support policy shall be available on nclubsoft.com and/or its partner’s Software portal for the reference of all stakeholders. Any modifications in the policy shall also be posted on these websites. C. Privacy Policy

Youpark and/or its partner neither believe in the policy of giving out, nor selling/renting the customer’s private information to any third party, for use in marketing and/or solicitation activities.

All of the personal information provided by the customers is used only to provide better services to Youpark and its partner’s customers and improve their shopping experience.

The customer’s personal information (which may include name, address, telephone number, e-mail address, credit card information, age and personal interests) may be required in various situations including but not limited to:

Registration with www.nclubsoft.com or Youpark partner’s Mobile Content
portal

b.
Participation in different promotional activities or contests.

Generation of a registration key by a software developer; in this case, Youpark may be required by the software developers to provide relevant customer information in order for them to generate a registration key and email it to the customer. If you have any suspicion regarding any misuse of your information by any software developer, please contact us immediately. Youpark cannot be held responsible for the privacy policies of any individual software developer. For concerns regarding the privacy practices of any software developer or independent software vendor/company, please contact them directly.

Youpark and/or its partner shall use the best possible mechanism to ensure that no individual information related to a customer is provided to a third party.

5.
Youpark and/or its partner may disclose the customer’s personal information only under special circumstances, such as when we believe it is required by law.

6.
Youpark and/or its partner may aggregate the customer information in order to better understand the customers and improve their shopping experience. Youpark reserves the right to share these cumulative statistics (and not the individual information) with Youpark business partners.

7.
Youpark utilizes cookies to provide the customers advanced services. These are small files stored by the internet browser installed on your computer system when you browse through Youpark and make transactions. However, these cookies do not contain customer’s private information. The customer has the right to change his/her browser settings to disable the receipt of cookies. However, these cookies must be enabled in order to complete a purchase transaction on www.nclubsoft.com or its partners’ software portal.

D. Security Policy

As stated in Youpark’s Privacy Policy, Youpark shall use the best possible mechanism to ensure that no individual information related to a customer is provided to a third party.

Youpark uses encryption to guarantee that any personal information provided by the customer (including names, address and credit card number) is 100% secure when it is sent/received over the internet. Youpark provides its and its partner’s customers complete assurance about the confidentiality of their personal information provided during a transaction.

If any unauthorized purchase is made using your credit card, as a result of shopping at Youpark or its partner’s software store, you shall be liable to pay nothing. Youpark has a strict policy of returning your full amount in case of any unauthorized use of your credit card.

E. Indemnity Policy

Youpark and its partner are hosting and providing access to software products developed by parties other than Youpark and its partner. These are NOT Youpark’s own products and Youpark cannot make any representation regarding the safety, quality or suitability of the software as these apply to a particular customer.

2.
Youpark shall make reasonable efforts to monitor the software products being distributed from www.nclubsoft.com or its partner’s site but does not guarantee to test, certify or validate any of these products.

3.
The customer is solely responsible for any repercussions resulting from the downloading, installation and use of any software. Youpark or its Partner shall not be held liable to any damages resulting from the downloading, installation, use, modification, or distribution of any software.

4.
Youpark is only liable to provide support to its and its partner’s users based on its support policy. Please refer to our Support Policy for details.

5.
Youpark’s indemnity policy shall be available on nclubsoft.com and/or its partner’s Software portal for the reference of all stakeholders. Any modifications in the policy shall also be posted on these websites. By visiting and purchasing from www.nclubsoft.com or its partner’s software portal, you provide your consent to the indemnity policy of Youpark.

F. End-User Policy

The software for your mobile developed by or provided to Youpark through its affiliated partners is protected by copyright and developers rights of ownership of the Denmark (1) Use of such software is governed by the terms of the end user license agreement, which accompanies such software. You can not Use the software unless you agree to the terms of such end-user license agreement. (2) You can not distribute, render and share the software with price tag unless Youpark gives you a written consent.

Once you have purchased and downloaded any content from www.nclubsoft.com or its partner’s Software portal you cannot cancel your purchase when the product has been downloaded towards your handheld device. If you are experiencing problems regarding download or installation please view our support policy.

2.
Youpark reserves the right to change the prices and situate new prices for its own developed software at any time.

3.
You agree and give your consent that all the charges and costs for sending or receiving text messages, download, updates, emails, or any other data transmission or use costs from any mobile operator, carrier, or other service provider are your sole responsibility. Please contact your carrier/mobile operator for information on data transfer charges.

4.
Youpark expects its and its partner’s customers to understand and agree that technical processing and transmission may involve (a) Transmissions through various networks (b) adjustments necessary to technical requirements of connecting networks.

5.
You agree and acknowledge that Youpark or its Partner(1) shall not be liable to you or to any third party for any modification, suspension, or discontinuance of its provided Services (2) reserve0 the right to Temporarily or permanently discontinue any component or all of its offerings at any time with or with out any notification.

6.
Youpark and/or its Partner shall not be held responsible for any of the repercussions or damages in the device resulting due to any software.

7.
For all Software’s developed by Youpark (a)Youpark grants you a non-exclusive, non-transferable license to install and to use the downloadable, free version of software (b) Youpark will not be responsible to provide support in 24 hours for any free of charge applications.

8.
You agree and acknowledge that (1) Any software which is developed and distributed by Youpark or its Partner as free version can only be distributed free of charge and can not be sold, leased or rented. (2)When you purchase any third party developed software from Youpark’s or its Partner’s software storefront you are only granted a personal, non-transferable, non-exclusive license, for using the software.

9.
You agree not to translate, reverse engineer, reverse compile, disassemble, or make derivative works of any software whether you purchased or obtained as free or trial version from Youpark or its Partner’s software store. You agree not to modify the Software or service in any manner or form, or to use illegally modified versions of the Software including, without limitation, for the purpose of obtaining unauthorized access to the Services or disabling features of the Software or Services. You agree not to access the Services by any means other than through the interface that is provided by Youpark or its partners for use in accessing the Services.

10.
With respect to Youpark and its Partner, any information and services provided or accessed through nclubsoft.com or its partner’s software portal:

(i)
Youpark and/or its Partner makes no warranties whatsoever with regard to any information, good or service including, without limitation, warranties of accuracy, completeness, usefulness, merchantability, safety or fitness of service

(ii)
Youpark and/or its Partner will not be liable, under any circumstance, for any loss, cost or damage arising directly or indirectly from any act or omission of any person or from any information, good or service; except to the extent the foregoing may not be disclaimed under law.

(iii)
Youpark and/or its Partner do not assume liability to subscribers or others for any failure to enforce any guidelines.

11.
Some of the information we collect from our users could identify them personally. Such Information includes a person’s name, email address, and credit card number. We will not share any individual’s personal Information with any third party without that individual’s consent except as required or requested by law or necessary for key generation by software developer. Youpark will not use any personal information you provided for purposes not even related to the services or promotions of Youpark for which you sign up, unless we notify you in advance and give you the opportunity to choose not to provide this information to us.

12.
Youpark’s End-User policy shall be available on nclubsoft.com and/or its partner’s Software portal for the reference of all stakeholders. Any modifications in the policy shall also be posted on these websites.
